Update on Gary Peel's bankruptcy fraud and obstruction case
Illinois-based
attorney, Gary Peel, was indicted in the Southern District of Illinois
on charges of bankruptcy bribery, obstruction of justice, and possessing
child pornography.
In
a nutshell, the indictment charges that Peel threatened to expose sexually
explicit photos of his ex-wife's 16 year old sister if his ex-wife
did not drop her objection to the discharging of certain debts
owed to her by Peel and sign a new settlement agreement modifying Peel's
financial obligations following the parties' divorce.
These
are unique allegations to say the least, and the case is a rare prosecution
under 18 U.S.C. 152(6), which prohibits knowingly and fraudulently
giving, offering, receiving or attempting to obtain any money, property,
remuneration, compensation, reward, advantage or promise thereof for
acting or refraining from acting in a bankruptcy case.
Several
defense motions to dismiss various of the charges have been denied
thus far, as has the defendant's motion to sever the bankruptcy fraud
and obstruction charges from the child pornography charges.
In
the latest development, the prosecution has requested a Daubert hearing
on the issue of the relevance of proposed expert testimony of defense
witness Thomas Hoops, CPA. More updates on this issue and the motions
to dismiss later this week.
