Foreclosure Injunction

A foreclosure injunction is not the same as thwarting a fraudulent foreclosure.

There may be some procedural or techinical issues regarding the lender's reasons for foreclosing.

An injunction is a determination by the court telling all parties, "Whoa, now everybody just cool your heals until we can sort this mess out. Below are some tips from fraud victims that had to be their own attorney.

Finding Information for Foreclosure Injunction

 

This was submitted to WJFA for victims needing to stop a fraudulent foreclosure in progress. This is from the victims and in no way is intended as legal advice.


1. Use a search engine, such as Google, and type in the words "CA foreclosure injunction." Insert your state's two letters. (Editor's note: Also use other search engines, such as Alta Vista. You'll get more results. Keep in mind that Google and others put paid web sites first, so don't go with the first couple links.

2. When I did it, it offered usable information and links, including one for the California Attorney General 's web site. It states that they are going after con artists in the realty mortgage business. But don't count on them coming to your rescue.

3. I believe you are better served as your own counsel. You save a lot of money. There's an enormous amount of reading, interpreting, comprehending, and decisions of direction, which you're forced in to as you also try to ascend the steep learning curve. It can be done and it helps to have a friend or willing person to bounce ideas and issues off of to make sure you got it.

4. Unless you already have access to a legal search engine such as LEXIS through a college etc. for quick case law research, you will need

a) If law libraries and their computers free-ish access aren't convenient, you should check out VERSUSLAW.com that costs $20 per month was the plan that helped me with a contract or long-term committment.

b) Find winning on-point caselaw (Injunction granted) to use, ideally for your state. Unfortunately Westlaw (Law/Caselaw Doc's BULLY nationwide) has co-opted process, virtually preventing ProSe access.

5. A second category of research and name to use is AJR, with breakdowns of issues by state/year, over five volumes, and very helpful, but also requiring a tutorial from a helpful library staff.

6. Seek Westlaw first, (likely available at law library, which is open to the public) to get linkage, context & history, including recent case and/or lawchanges(apls/revsls) able to save wasted effort on theories/findings no longer applicable. The library staff should be able /willing to show you how Westlaw works, but they also may be tainted LawyerLovers, enjoying your plight and shyster-protective. There should be at least one person (supervisory) able to get you familiar with Westlaw.

After getting caselaw lists & statute histories & notes(shows intent),
you can then search Versuslaw for specific cases.

The big difference with Westlaw is that they give hyperlinks to almost all linked or cited caselaw, saving much time spent crossreferencing.

Versuslaw does not, but is still quite helpful.

Searches worded several different ways will yield different results.
