Rule 13 - Counter Sue

FRCP §§13 allows you to get back in the Plaintiff's face, legally with a counter lawsuit. This means, you need to be prepared that the person you are suing, may turn around and counter sue you on related charges.

Under 13(b) The defendant gets to sue the plaintiff for any non-related claims.

The only catch is that if the defendant's claim is STOO (same transaction or occurrence) and it does not require any indispensable third parties, 13 (a) states you have to assert the counter claim at that trial. Use it or lose it, is how it is considered.

 

Think of it this way, if you are a fraud victim

If you, the fraud victim sue Wiley Crook for steeling your business equipment, but it turns out that you are not exactly the innocent victim you say you are, Rule 13 lets the other guy counter sue you.

But let's say you lose your home in a foreclosure and the lender sues for the difference in what the home sold and what you still owe. Under Rule 13, if you have a legitimate case, you could counter sue the lender for all its actions that cause the loss of the home if you have the evidence to show the foreclosure was bogus.
