Birds with One Stone Rule
Okay,
you find yourself having a boat load of claims against this one particular
defendant, but there's only so many days in a year and you've got better
things to do than sue this guy one case at a time.
Wouldn't
it be nice if you could bring all your cases to one court at one time
and be done with it?
The
Federal Rules of Civil Procedure have put together a lawsuit package just
for you.
FRCP
§§18, is best known as The Hook 'em Up Rule. There are a few
catches here though.
1.
If you and the defendant are nondiverse, go for it! You can join until
the cows come home.
2.
If you and the defendant are diverse, you can pretty much guess what happens
- that pesky ol' §§1332 and his buddy §§1367 are going
to rain on your parade.
As
long as you have federal question claims, you can join those, and you
may join any of those nonfederal claims that have a common nucleus of
operative facts.
But
as for those separate and independent nonfederal claims, no go, my friend
because §§1367 will not allow it.
